Jay Leno, 76, secured legal authority over Mavis Leno’s finances on April 9, 2024, following medical assessments showing she had lost the capacity to manage her own economic decisions.
Medical documentation presented to the court revealed severe deterioration in the 79-year-old woman’s mental state. A neurologist’s assessment from November 28, 2023, found progressive cognitive impairment that left her unable to comprehend legal proceedings or take part in them effectively.
According to court filings, she had been “progressively losing capacity and orientation to space and time for several years,” a decline that “renders her incapable of executing the estate plan.” Her appointed counsel stated that Mavis “sometimes does not know her husband, Jay, nor her date of birth.”
The Conservatorship That Started It All
The former “The Tonight Show” host filed his petition with Los Angeles Superior Court in late January 2024, seeking conservatorship status to create a living trust that would provide for her ongoing needs if he dies first. His longstanding oversight of household finances formed part of his justification for seeking formal legal standing.
Judge Brenda Penny approved the request after determining that clear and convincing evidence supported the need for intervention and that the entertainer met requirements as a proper conservator. Mavis offered no opposition through her attorney, consenting instead to her spouse’s designation. The court found the structure represented the most limited restriction possible given her incapacity for financial decisions.

The Keystone Law Group released an updated analysis with partner Roee Kaufman leading the research and managing partner Shawn Kerendian providing final approval on January 13, 2026. The firm noted that putting proper legal protections in place sooner might have avoided the necessity for substantial judicial involvement after Mavis lost the ability to construct a plan on her own.

The comedian has spoken candidly about his determination to stand by his wife of more than 40 years, no matter what obstacles her illness brings.
